Apply For Spanish Nationality

Hi everbody,

Hope somebody know some information, I am Non Eu National married to a Spainard over a year,I do have my NIE which is valid for 5years and family book, I am a bit curious wether I could apply for spanish nationality b’cause I read somewhere if ur married to a spanish national over 1 year ur entitled to apply for the nationality, hope somebody knows something about this , if so where do u start what department you contact and do I have to get any papers from my country, and also how long does it take the spanish nationality..

Yes, you can apply already. You need to go to Registro Civil in your town and ask for a “cita previa”.
All you need for now is your NIE and ‘estar empadronado’ in the city of this Registro Civil. Perhaps Libro de Familia (though your spouse is on your NIE).
I just did it in Barcelona in March 2009 - and i was given a date in January 2011!!! Thats way too much time to wait (depends on province).  You’ll be given a list of all the papers you need for this date. I was told that I might get an earlier date as well, and that I would be informed by phone.

Let me know about your waiting time for “cita”.

I am in the same position , however I am now separated from my Spanish wife. Is my application still valid if we do get divorced. We have been married 3 years and living in Spain.
If anyone has any info if this would effect my Spanish Nationality application.

No. Your spouse needs to be present during the interview with a judge when asking for a citizenship, with 2 witnesses I believe. All of them will be asked how well you are intergrated into Spanish society, blah blah blah.
Try to convince your spouse perhaps to help you out, if you are still on a good terms.

Thanks for reply , will have to speak to her about this. We are also expecting a child together which complicates matters as I really want to be part of this childs life. I have a tarjeta de residencia (familiar) until end 2011.
Can I then apply for another 5 years residency ? I am South African and still required to travel with my passport.

I want to live in Spain as it has become my home and I really enjoy being here.

Am I entitiled to live here on the residency card ?

for all the info, I did manage to go to Register Civil, I was given the same dates as you Ed,2011 so nothing is changed, I guess we have to wait, I have also contacted a lawyer who said he knows somedody he could get a faster date, I don’t believe him but lets see.. thanks once again

This is the first I’ve heard about NIE being valid for 5 years - I thought it was unlimited.  Did I miss something?  Or is it different for EU and non-EU?

Well its Spain, I would not be surprised if with the right contacts you could get an earlier date…
Please let me know if you succeed with an earlier date with your lawyer.

As for NIE for 5 years - we were talking about non-Eu citizens.
