In mid June I was involved in a head on collision with another car, which was overtaking an unmarked Guardia Civil car, between Altea and Benidorm Because a police vehicle was involved the case is to be heard in court.  The traffico, apart from breathalising me,  were pretty relaxed about it, I was not even asked to give a written statement, nor have I yet received anything in writing from them.

I am not sure how these things work in Spain, will I be asked to attend court, does the court apportion blame, and will I be awarded damages, or must I pursue the third party, (my wife was in hospital for eight days with cracked ribs).  My insurance company, Saga, have been on the ball, and paid my wife hospital benefit, and arranged to supply me with a new car next month, but are reluctant to answer my questions about my uninsured losses, which will come to over ?3,000.

I am not a resident in Spain but spend 4-5 months of the year there.

Hi,  I was involved in a car accident a year ago which was not my fault.  I, however, am resident so I?m not sure how much the 2 cases will differ but this is what happened:  the police were called, they took a statement and photos of the cars and breatalised me.  I was taken by ambulance to hospital, not Seguridad Social but a private hospital, where they took x rays, etc.  The next day I arranged to meet the other party at his insurance office where he signed a document accepting full blame for the accident.  All physio, etc I needed was done through the private hospital and paid for by the other party?s insurance.  A court date was set but we never arrived to court as an offer was made beforehand which we accepted.  All in all, it took about a year. 

Like I said, I am resident and live in Spain all year round so your case may be treated differently.
