Fiscal residence and NIE

Hi all!
Is having a NIE enough for an EU citizen to be a fiscal resident in Spain? i.e. to pay taxes in Spain instead of his country of origin?

No solely having an NIE does not make you fiscally resident or indeed any sort of resident as non residents need NIE if they own taxable assets.

- you must also make regular annual tax declarations on your worldwide income and spend in excess of 183 days p.a. in Spain to become fiscally resident.

so, if i understood correctly, NIE plus more-than-183-days in Spain would make me a fiscal resident, right?

You’ll also need to apply for your “certificado de residencia” after 6 months which is formal proof that you are resident for tax purposes in Spain.

Does anyone have a url for where ?certificado de residencia? can be found?
been living in spain while studying for some years, started an internship about 6 months ago and was shocked when I realized I pay
24% of a position which pays about 6? pre-tax and consist of 20hrs per week. Something is wrong there,
wonder why no one told me I needed this form….

Do you also know what happens in the following situation: if you are working in Spain, but your employer is abroad and you don’t get any revenue from Spain ?Under which conditions do you become ‘fiscal resident’ in Spain? Can you be ‘fiscal resident’ in two countries? (e.g., living 180 days in both, and the rest in holidays in a third country)

Simona, no you cannot be fiscally resident in 2 EU countries cant speak for elsewhere but I doubt it - if you think about it is pretty impossible. (And yes I do understand you cant pay tax on say Uk Govt pensions in the Spain.)

Sounds like you are trying to beat the system - well good luck! Now governments are broke the rules are getting even tougher.
