Yikes, that’s quite the story. I definitely can’t help you plot a scheme to get the apartment back, but perhaps a good lawyer would help you with that… take a trip to Madrid and interview a few. 😉

I am NOT a professional but my view (for what is worth) is this - if you are still on the Spanish deeds (escritura) then it is still half yours, if she never took the action to remove you then that is her problem. However of course if you have legal ownership rights then you also have liabilities - I agree with the boss why not take prfessional legal Spanish advice.

To be honest the childrens inheritance remains the same, but as non residents they might have fees/taxes to pay - depends on the province as this law is regional and so it varies.

If it wasn’t included (or mentioned), both of you still own it. If one wants to sell it, will also need the other sign. And both deserve the revenues.
