The landlord said that I do not have any rights to talk aboout rent deposit!!

I’ve been staying in Spain for almost 2 months, and I’ve been living in this room less than 2 months.
I am living with the landlord.

Unfortunately, the landlord has touched my stuff and sometimes has entered my room without asking me.
It’s so stressful, and makes me want to move out. So I’ve told her I will move out and ask to give me back rent deposit.
But what she said is I do not have any rights to talk about the deposit and she doesn’t want to loose the deposit.

When I decided to stay here, she asked me how long I will study in Spain(here is Salamanca), so I answered her that
I will study for one semester. However what she’s just told me that I told her I will stay in this room for one semester.
Moreover, I can get the deposit back only when I move out after six months.

I think it doesn’t make sense at all. Becuase I’ve never broken anything and I’ve never told her I want to live here till Feburary.
There is no paper or written contrat and there is only written receipt which shows that I paid rent deposit.

There is one more weird thing.
I started to live here form 23th of September, and 1st of October the landlord aked me to pay for all rent of September
and all of October. So I thought it is wrong, and I asked why I have to pay all of rent for September.
And she answered that because I decided to contract on 8th of September. But she and I both are totally not positives when I
visited to see this house.


The rent deposit was 100 euros and I really want to get it back.
Becuase since I told her that I will move out, she’s been bothering me too much.
Also she knows that my Spanish is not that good, so she looks like ignores me and when I want to talk to her,
always she stops me and doesn’t hear what I say.

Please help me, I have just 5 day left in this room. How to get my money back?

I don’t think you will, there is no contract her word against yours. I think in this case you will just have to accept it.

I am afraid that you are not likely to get your deposit back.

If you had made a contract you would most likely have been committed to a minimum stay in the rented room.

Despite it being her word against yours I am afraid that you also need to understand that from a landlords point of view, if you are unable to commit to something more substantial it may be worth you seeking accommodation in a hostal until you have more of an idea about what you want to do

Make sure that the next time you get something in writing to at least protect you from loosing your money again

Hi HM,
Sorry to hear of your troubles.
I know Eu100 is alot to you, but if it is that stressful and you need to move, then I can only suggest you walk away.
(My last landlord did not return my Eu300 deposit, even though I had been renting a studio on his property for 5 yrs, paid all the rent and also looked after his animals for free when he was away for extended periods of time.)
Even though I had a written (private) agreement/contract with him, I was just happy to have him out of my life. (Too complex to explain here, but I was in the middle of a war between him and his other tennants and it was dangerous and I had tomove for my safety!) 

Can friends/family send you Eu100 to cover this loss?
