My wife is Italian Citizen, what do we need to move to Spain?

I would really appreciate any help in here. My case is below:

My wife is Italian Citizen, I am dual (Brazilian and Canadian Citizen). We both live in Canada.
I have the opportunity to work for my current employee based out Spain but we don?t have a spanish branch company and the company will not be applying for any visa for me (it is my responsibility to take care of that).

My job is mainly making product presentation world wide and I will keep all my income through Canada, including my taxes.
The consulate told me that I can not get a residency visa just because I want to live in Spain however, I can move to Spain if I am accompanying my wife as she is Italian Citizen but they have not been very useful on giving me details on how I should proceed.

How should I proceed if we want to move to Spain and myself accompanying her? I will require to travel in and out Europe and want to avoid been bothered by Spanish customs when returning to Spain, so I need to be 100% legal. I don?t need a work permit as I am not going to be working in Spain itself but my wife wants to work there as EU citizen.

One last details, we have enough savings and proof of Income to cover ourselves for over 1 year.

Mainly I need to know if I should apply for a Visa prior to move or we should move as visitor and apply for residence when in Spain (I want avoid any customs/immigration trouble and tell them the true). Please, if you are aware of forms or requests I need to make let me know.

It sounds like you’ll have to get your marriage registered in Italy first, then get your Italian passport. Then you’ll be in Spain as an EU citizen as well. Make sense?

Citizenship request for Italy is not simple and takes a long time. I hope to find an easier way.
I read other threads and I see couples have done the same via different ways, mainly entering as a tourist and the EU citizen requesting residencia and the spouse applying as accompanying.

I hope someone with similar experience can help in here.

If you’re opening a business, why not go in as a tourist and then hire yourself? Look around the site here for ‘autonomo’

I am not opening a business. I am employed by a Canadian company and I can execute my job based almost anywhere in the world. I mainly execute product presentation and sales around the world (except in Spain).

I only want to live in Spain with my wife, who is Italian Citizen and will work or study. She can request residencia in Spain but I need more details on how to proceed in my case if I am accompanying her.

Can some one help with more info?

Robi, Thank you very much for the document that you sent. The “Residencia Brochure 2007.pdf” has clarified all my questions and I am very glad that as a spouse of a EU Citizen and accompanying my wife I can not only live in Spain but also work (even though I plan to keep employeed by my current Canadian employeer).

By this document it doesn’t look like that is much burocracy for both of us to apply for the residencia but that I will see when I start the process.

Thank you again. You have been way more useful then the Consulate of Spain in Canada.

OK no problem! The document came from the Spanish Immigration web site - perhaps they dont know about it in the Spanish Consulate in Canada. For anyone else reading this can wants to read the document you can visit the site at (there is a lot of it in English):

here is similer problem.  I m an Indian citizen working in spain since last 7 years and have parmanant residencia,
three years back i got married in india with an indian girl. How can i bring my wife to Spain to live with me.
