I was not sure where to post this I hope it is ok to post here,I was assualted a few nights ago I live in the Costa Blanca and I live in an apartment, the people in the apartment above me were making alot of noise so my boyfriend & I went up to ask them to be quiet it was 2:00am in the morning, anyway they just shouted abuse at us they were here on holiday and the woman attacked me. The woman who attacked me was here on holiday but her mother owns the apartment and was there when the incident happened. I must point out the people are English. The incident was reported to the police and the case is being taken to court. What my question is, I live here in Spain now but the woman that assaulted me is only here on holiday probably just for a few weeks, so what will happen, if the court case comes after she leaves Spain, will they just rule in my favour and then make her go to court if she re-enters Spain? I just don`t want this woman to get off scot free, she committed a crime so she must pay for it. If anyone knows the procedure I would be grateful for any information many thanks.

According to what I have read:

I think if you have taken out an official denuncia with the Guardia Civil and not just the Policia Local and they want to take it to court then all parties must appear. Those that dont will be in breach of the law and will be placed on an arrest list - these things do not go away.

But I would think it is unlikely to get to court before she goes home - unless it was very serious.
