Under than 183 days in Spain Barcelona as a EU citizen, have to pay add. non-resident 24% tax (IRPF)??

Hello all,

I just moved here in the beginning of July this year to look for a work. I managed to find one, and started to work in the first of September. But now they are telling me in this job recruiting company that I have to pay this extra non-resident IRPF tax which is 24% as I have been here in Spain under 183 days? I am an EU citizen and all the working permits are fine, I have the NIE, social security number and all the documentation needed to live here in Spain. (And don?t know if this affects, but I was studying here in Bcn in 2005-2006 a Masters degree..) I also called the local agencia tributaria in order to ask the matter and they said no, I only have to pay the obligated taxes related to work (and as I have the NIE everything should be fine, there are NO rule that if you have been living here under 183 days you should pay smth extra taxes). Because of that I went to the local tax office to ask this, from there I filled this paper that I am a spanish residence, currently living and working here. They said they will send me a paper by post concerning the taxes I have to pay here (to give for the job recruiting company), but for now (it has been almost two weeks now) I got only this paper indicating I am a part of the social security system (as I am working). So anyone knows how these matters work here, I?m a bit lost now….??? Many many thanks!!!!

EU citizen of what state ? new members state have to pay extra taxes , i come across this befor but not in spain think was in UK

hello!

I am from Finland, we have been member of EU in 1995 if I remember correctly? I have not heard that it would matter in this case from which country of EU you are from. This is the first time I hear this, so I was a bit more than surprised!! and IF I really have to pay this extra tax, is it really so, that all this two months I have been here before starting to work on September, doesn’t count? Thanks a lot for your help!!

Hello!

Yes I have been checking at these sites many times, can you pls tell me which of these matters concern about the taxes from the salary? My spanish is not that good and Im only able to find matters related to other taxes..

I had a look that page you mentioned, but didn?t notice any section where would be mentioned some special taxation for non-residents under 183 days..?

Hi. I had to pay this tax for 1 month before switching to the normal tax code. You need to prove to the gov that you intend to stay longer than 6 months in order to stop paying the high tax.

OK. That sounds reasonable. So in other words I just have to get some paper somewhere which indicates I am going to stay here longer than 6 months (which kind of paper for ex)? And where/ which place I have to go with that paper in order to avoid it?? Many thanks for your help!

Alternatively find any government office (ex. the one behind fnac - Pl. Catalunya) and go in and ask to be pointed in the correct direction.

Yes flat lease! We have made the contract until June 2009. Perfect. This job Im having now is temporal, 6 months. And they were planning to take the highest 30,5% for the whole time… crazy. millions of thanks!!
