I think people judge too quickly many things... Telefonica isn't in a monopoly for years, in big citys other operators have their own infrastructure and provide directly their lines, in smaller it's up to them to install their own facilities or then can use the infrastructure of Telefonica.
The link you posted isn't a letter that's send out to anyone, if you translate the title "SOLICITUD DE INHABILITACION TOTAL O PARCIAL DE LA PREASIGNACION", it's a letter that's sended to customers that request to change their lines back to Telefonica (If you have contracted Tele2,Jazztel or similar, you can call Telefonica to switch back to them). Once you call and ask them to get back to Telefonica they send you this letter that you agree with the cancellation of the other operator and route your calls again via Telefonica. If you look at the first page and translate the first word you'll read also that this letter is send on request by the customer over the phone.
