UK man wishes to move to UK with Bolivian partner

Hi, Please excuse me for contacting you in this way but I have been searching the internet for weeks for some

sort of answers and am not finding out any information that I need

I am scared to pay some of the other Lawyers I have contacted on the internet because I am obliged to pay for a consoltation and obviously our situation only allows us to really make one payment,

I am looking for the Lawyer that can genuinely help us and not just take our money.

I have been getting bounced around between immigration lawyers who tell me to contact the British Embassy in Mallorca
who in turn tell me they cannot advise on such matters and to contact an immigration lawyers.

I dont have much faith in many and due to my partners circumstance, I am reluctant to provide to many personal details incase it
back fires on us.

I hope you can understand this is a very frustrating situation for us both


Here is my problem,


Hello. I am a 30 year old UK citizen who is currently living on the
island of Mallorca, in the Balearic Islands, Spain

My Partner is aged 21 and a Bolivian National.
She has been in Mallorca 2 years and 4 months having come here with her
mother who had recently divorced and seperated from the rest of her
family at the time they come to Spain.

(she really didnt have much choice at the time, as although she was over 18, she would of been left with no family or home in Bolivia)


Her relationship with her mother seriously broke down within weeks of her arrival and despite being able to support

herself with work it has not been an easy ride for her.


She does not have legal papers to live and work in Spain, having come
here on a tourist visa and not going home within the 3 months she was
allowed to be in Spain.

(i know this is illegal but are there special circumstances as mentioned above in the family breakdown)

She is working however, and we have been informed that if she can
complete over 3 years work in her office she can apply for, and be
granted papers.

we have met other bolivians in the same position, who have been granted
papers to legally live and work in Mallorca.

( i am under the understanding, that it is her boss who is penalised if
she is caught and not her)

My question is this.

I would like us to be able to return to the UK to live and to work.

The situation for us both in Spain in getting worse and I am unable to find employment of any kind.
We are currently engaged and plan
on getting married within 6 months of arriving back in the UK.
(we have been together, living, as man and wife for 2 years in April

We are prepared to get married earlier than later if need be, but I dont
think this would make much difference, would we have to get married in
Spain, the UK, or in Bolivia??
Would this be classed as an alien marriage?

My girlfriend speaks excellent english and would be more than willing to
work if she was allowed, if she would not be allowed to work, then that
would be accepted.

I have the finnances and support to be able to support us, My mother has
said it would be no problem for us to live in her flat.

My girlfriend has expressed a wish to study at college or university over
the past few years, but due to her situation in Mallorca was obviously
not allowed to study in any way.

My biggest concern about the whole matter is this.

We would be able to leave Mallorca together, but if the UK would not
allow my girlfriend to enter, then she would also be denied re-entry
back into Mallorca, and therefore would have no option but to return to
Bolivia, which is what neither of us really wants to do at this stage in our lives

I dont know if I could sponsor her as a defacto partner, or if my family
could act as her guarantor.

I would really like to know the options we have before we start the visa
application process.

Its all a bit of a mess, so I would appreciate any further information or
where to find out the answers on this subject on this.

I am understanding that to apply for a visa you must be in your country
of residence at that time,

would it be as simple as for her to fly back to Bolivia for a short time
and to apply for the visa before flying to the UK.

Would the fact that she overstayed her tourist visit in Spain be noted on
her application for a UK visa ?

and if so would it affect the application proccess?

I would really appreciate any help from you on this matter as its causing
lots of problems at the moment and we are really unsure about the best
approach to take,

The bottom line is that we both want to enter the UK legally and above board,

I am confident that if she was only granted a visitor visa, and not allowed to work, that once in the UK we would be able to apply for a different visa for her, appeal any desicions and to create a better life than we have here,
