Legal Assistance! - Urgent! INSURANCES OMBUDSMAN - Motor Insurance

I have hired a lawyer in Fuengirola to help in my car injuries claim. (He was on the list recommended by the British Consulate).
Whether through poor ‘bed side manner’ or some other reason (?) we have reached a stage where I may stand to loose ?2,500 that I had to pay out for medical treatments.
The court forense decided that as there was a long gap between the accident date and my first major treatment they did not allow the injuries that were finally found to have been caused.  (Slipped discs).
I would like to know if anyone has complained to the Insurances Ombudsman regarding their motor insurers -and the outcome.
IMO it was a big C*** up from the beginning and this has resulted in this possible* loss.
(I have been told to accept the offer by the other side - *but as I would loose out big time - I would prefer to go to trial and see if we could argue our case there).

I do not wish to switch lawyers at this point - as he at least knows the ropes/is respected in the local court.  Just a shame he is not very hands on!!!!

Any info on making complaints/success of same against Insurance Cos, lawyers etc would be welcome!

(I do not usually get hot under the collar about these things - but to be instructed by the Insurance co’s own lawyer to spend all that money - without it being explained there was a risk of not getting it back is negligence on duty of care IMO.  I have tried to negotiate with them about it - but they refuse to accept responsibility for the advice given to me by their own lawyer????).

ps - crash date was over 18 months ago and due to ‘other proceedural problems’ it took this long to even get to see the forense/the case heard!!!! (Even though the Guardia retport puts the other driver 100% to blame - Plus he ran away from the scene!).

Update…
I am pleased to say that after many hundreds of hours of blood, sweat & tears… I finally got my money - including the amount mentioned above.
I don’t know what the lawyer said to the other parties insurance co… but it seemed to work!

I will however, still be writing to the Insurances Ombudsman.. as the whole thing was poorly handled & IMO my own insurance co did not stick to the contract.

BEWARE OF LIBERTY SEGUROS!!!
They are the biggest provider of Car Insurance to Ex Pats… but DO NOT STICK TO THEIR CONTRACT!
Infact (some sort of poetic justice here???)... they are even refusing to pay my lawyers own Procudura fees….
