Marriage / Work Contract / Or Just Run the Gauntlet?

There seems to be very varied views on the internet on how to remain in Spain as an Australian.

I am a young Australian, moved to Spain to live with my boyfriend after spending the previous 12 months working in London (yes, in the construction industry as a project manager when everything decided to stop due to the ‘crisis’). I realise that Australia does not have any ties with Spain, so when I went home prior to arriving here I did not attempt to get a visa (as it is impossible unless I am a student or have a job).

My initial plan was to travel here, hoping to find some kind of lowly paid work (illegally), leave every 3 months and return. But then I realised that I am legally only allowed in the Shengan Countries for 90 of every 180days….not exactly like Asia where you can make a border run and extend your visa.

Obtaining work illegally has also been a little harder than I imagined due to all of the English workers who are legally allowed to work. Even the tuk-tuk drivers have papers!

So I was wandering if anyone had any advice on the following options which I am considering:

a) Obtain a work Permit
To do this, I have been told that I need to return to Australia to obtain a visa. But would I have to do this after I find a position? Does anyone know if I could just travel outside of Spain / Shengan, perhaps to England and obtain instead? Australia is a LONG way a way!

b) Obtain a work Permit by asking a friend to Register me with their Own Company
I have a friend who owns their own company. Am I able to get a contract with them, but not actually work with them to have papers in process and at least be able to live here legally? Am I required to work a certian number of hours and pay income tax to prove that I am employed?

c) Create my own Business
Am I able to register a business here in Spain and stay on these terms or does it need to be an established business, with a history?

d) Get Married!!
Not exactly how I pictured my wedding day. But there are also a few complications. My boyfriend is Peruvian. He is here working as a doctor and has been for 7 years, but is currently still classed as a student as he is doing his specialty. I would be able to remain in Spain legally if we were married, but would I be eligible to work? Also the process for marriage seems to be long. Am I allowed to stay in the country whilst we went through the paperwork process? I have approximately 6 weeks remaining on my Tourist Visa.

e) Remain Illegal
Live and try to get work here illegally. In a seperate blog someone mentioned that if you remain in a country illegally all of your insurance is elligible. Does anyone know if this is also for travel insurance??

We cannot get involved in Visas issues only to advise you the correct “Legal” path of obtaining a visa.

The rules are tight since la crisis more harsh punishments so on so fourth…...
