We bought an apartment in a block and a community has been formed. However, since the downturn in the economy, the builder cannot sell the majority of the apartments (24 apartments in total of which only two have been sold, one being ours) implying that he has the majority vote in all things relating to the community. For two years now we have been unable to use the garage, the pool is irregularly maintained,no communal cleaning,  the lifts are not in use and recently the communal electricity and water have been cut off. I am very worried about the lack of communal electricity as we have no lighting in the stairs and we are in a top floor apartment and of course am terrified about what this could mean for us in the event of a fire. I need to know what our rights are relating to all these issues. Thanks in advance for all suggestions.

Sadly this is a sign of the times and it sounds very much like there simply is not any money left in the pot to pay for the upkeep of the building.  It may be possible to take on the communal electric between you and the owner of the other sold apartment.  You don?t say where you are in Spain but you may like to give the express legal cafe in La Nucia a call.  They are always happy to give free advice over the phone and may be able to help you. I would say if you are living there legally with a Licencia de primera occupacion then you may have some rights but if not you do not have much ground to fight for your rights.
